सरकारी नियुक्त्यांमध्ये आरक्षण अधिकार नाही

भारताच्या माननीय सर्वोच्च न्यायालयाचा निकाल - सरकारी नियुक्त्यांमध्ये आरक्षण अधिकार नाही

भारताच्या माननीय सर्वोच्च न्यायालयाच्या दिनांक ७ फेब्रुवारी २०२० च्या निकालानुसार सरकारी नियुक्त्यांमध्ये आरक्षणाचा नियम हा  कोणत्याही श्रेणीचा अधिकार नाही. OBC, किंवा अगदी SC/ST साठी देखील हा निर्णय लागू पडतो.  भारताच्या माननीय सर्वोच्च न्यायालयाच्या पाच न्यायाधीशांच्या घटनापीठाने देखील स्पष्ट केले आहे की सरकारी नियुक्त्यांमधील आरक्षणाचा नियम केवळ तरतूद सक्षम करणारा आहे आणि अनुसूचित जाती/जमाती सह कोणत्याही श्रेणीचा अधिकार नाही. (संदर्भ -सी ए राजेंदिरन बनाम भारत संघ वर्ष 1968). सध्याचा दिनांक ७-२-२०२०,चा निकाल  मागील निकालाचा पुनरुच्चार आहे.

वरील निकाल दुरुस्त करण्यासाठी, भारत सरकारला भारतीय राज्यघटनेच्या अनुसूचीमध्ये आरक्षणाचे सर्व नियम समाविष्ट करण्यासाठी भारतीय संविधानात सुधारणा करावी लागेल आणि विधेयक मंजूर करावे लागेल, जे आमची दलित वैद्यकीय संघटना  तामिळनाडू  हा मुद्दा घेऊन साध्य करण्याचा प्रयत्न करत आहे.एवढ्या वर्षात सरकारी सेवांमधील नियुक्त्यांमध्ये आरक्षणाचा नियम लागू करणे हे कोणत्याही सरकारचे बंधनकारक कर्तव्य होते, परंतु तरीही, विविध प्राधिकरणांनी अनुसूचित जाती आणि अनुसूचित जमातींसाठी (ज्याला SC/ST अनुशेष पदे म्हणून ओळखले जाते) अनेक पदे भरलेली नाहीत. केंद्र आणि विविध राज्य सरकारे एकत्रितपणे ज्याची संख्या लाखोंमध्ये आहे-  भारताच्या माननीय सर्वोच्च न्यायालयाच्या निकालानुसार, आरक्षण धोरणाची अंमलबजावणी करायची की न करायची हा निर्णय सर्व सरकारांना देण्यात आला आहे कारण, वरील निर्णयानुसार, सरकारी नियुक्त्यांमध्ये जाण्याचा आरक्षणाचा नियम हा अधिकार नाही. कोणत्याही श्रेणीसाठी- OBC किंवा अगदी SC/ST साठी देखील

वरील माहिती माननीय संसद सदस्यांना देखील देण्यात आली. त्यात जवळपास सर्व SC/ST M.P.s, Communist M.Ps, ख्रिश्चन आणि मुस्लिम M.P. इतर राजकीय पक्षांचे लोकप्रतिनिधी देखील आहेत. यामध्ये केवळ तत्कालिन खासदार रामविलास पासवान यांनी याची दखल घेतली आणि भारताच्या माननीय सर्वोच्च न्यायालयाच्या वरील निकालात सुधारणा करण्यासाठी भारतीय संविधानाच्या नवव्या अनुसूचीमध्ये आरक्षणाचे सर्व नियम समाविष्ट करण्यासाठी संसदेत घटना दुरुस्तीची मागणी केली. ज्यासाठी भाजपचे राष्ट्रीय अध्यक्ष  जे.पी. नड्डा यांनी लगेच प्रतिक्रिया दिली, "आम्ही पूर्णपणे सहमत आहोत. आम्ही ते करण्यास बांधील आहोत, "(,दोन्ही 13 जून 2020 रोजीच्या हिंदू इंग्रजी वृत्तपत्रात नोंदवले गेले.)  पण दुर्दैवाने, रामविलास पासवान जी संसदेत हा मुद्दा उपस्थित करू शकण्यापूर्वी, पासवान जी यांचे हृदयविकाराच्या झटक्याने निधन झाले, आणि त्यानंतर जे पी नड्डा यांनी मान्य केल्याप्रमाणे घटनादुरुस्तीची कोणतीही बातमी नाही!  त्यानंतर, दलित मेडिकल असोसिएशन तामिळनाडूच्या वतीने, बीसी कल्याण आणि एससी/एसटी कल्याण या दोन्ही संसदीय समितीकडे निवेदने पाठवली गेली आणि संसदेत घटना दुरुस्तीची विनंती केली.  SC/ST कल्याणासाठीच्या संसदीय समितीने हा मुद्दा भारत सरकारकडे उचलून धरला आहे. मात्र आजपर्यंत कोणतेही योग्य उत्तर मिळालेले नाही.

त्यानंतर  तीच मागणी भारताचे महामहिम राष्ट्रपतीं आणि  प्रधानमंत्री यांना  सादर केली. दोन्ही विभागिय कार्यालयांकडून सदर मागणीचे  पत्र सामाजिक न्याय आणि सक्षमीकरण मंत्रालय, भारत सरकार यांच्याकडे सल्ल्यासह पाठवण्यात आले.  वरील विषयावर, भारत सरकारच्या सामाजिक न्याय आणि अधिकारिता मंत्रालयाकडे प्रतिनिधित्व करण्यासाठी म्हणून माननीय वीरेंद्र कुमार, सामाजिक न्याय आणि सक्षमीकरण मंत्री, सरकार यांच्याकडे निवेदन केले आहे. तरीही ही मागणी थंड बस्त्यात पडून आहे. संसदीय निवडणुकांच्या या कालखंडात  SC/ST/OBC च्या सर्वांगिण कल्याणामध्ये स्वारस्य असलेला कोणताही राजकीय पक्ष निवडणुकीपुरते, मतदारांना वचन देऊ शकतो. मात्र तसे होतांनाही दिसत नाही. सर्वच राजकीय पक्षांची याबाबत उदासिन भूमिका असल्याचे दिसून येते. भारतीय राज्यघटनेच्या नवव्या अनुसूचीमध्ये आरक्षण धोरणाचा समावेश करण्यासाठी संसदेत, भारताच्या माननीय सर्वोच्च न्यायालयाच्या वरील निर्णयात सुधारणा करण्यासाठी घटना दुरुस्ती होणे अत्यावश्यक आहे. त्यासाठी आम्ही प्रयत्नशिल असल्याचे  दलित मेडिकल असोसिएशन तामिळनाडूचे संस्थापक अध्यक्ष. आणि ग्रामीण आरोग्य सेवांचे निवृत्त सहसंचालक.डॉ के पुगाझेंधी यांनी कळवले आहे.

Sub: Hon'ble Supreme court of India Judgment - Reservation in government appointments - *Not a Right* - regd.

   As per the Judgment of Hon'ble Supreme court of India, dated 07.02.2020, ,the rule of Reservation in Government appointments is not a Right to any category- OBC, or even to SC/STs. 

  Even the Five Judges Constitution Bench of Hon'ble Supreme court of India have clarified that the rule of Reservation in Government appointments is only Enabling provision and not a Right to any category including SC/STs(Ref. C A Rajendiran Vs Union of India, in the year 1968).

     The present Judgment( dated 07 .02.2020, referred by me ), reiterated the same judgment. 

       To rectify the above Judgment, the Government of India have to amend the Constitution of India to include all Reservation rules in the IX Schedule of Constitution of India and pass the Bill,which our Dalit Medical Association Tamil Nadu is trying to achieve by taking this issue to various authorities.

              All these years it was bounden duty of any Government to implement the rule of Reservation in appointments in Government services, but even then,the various authorities have not filled up many posts due for Scheduled Castes and Scheduled Tribes ( known as SC/ST backlog posts which runs into many lakhs- both Central and various State Governments put together!

      As per the Judgment of Hon'ble Supreme court of India, the choice is given to all Governments to implement or not to implement the Reservation Policy because, as per the above Judgment, the rule of Reservation to get into Government appointments is not a Right to any category- OBC or even to SC/STs!

      We have shared the above information to Hon'ble Members of Parliament, -

 almost all SC/ST M.P.s, Communist M.Ps, Christian and Muslim M.P.s of political parties- sometimes repeatedly!

   The (Late) Ram Vilas Paswan ji took note of this and demanded Constitution Amendment in the Parliament to include all Reservation Rules in the IX Schedule of the Indian Constitution to rectify the above Judgment of Hon'ble Supreme court of India which says that the rule of Reservation in Government appointments is not A Right to any category including SC/STs., for which Mr J P Nadda, BJP National President, immediately responded by saying, " we entirely agree with you and we are bound to do it, "(,both were reported in THE HINDU English Newspaper dated June 13, 2020.)

  But unfortunately, before Ram Vilas Paswan ji could raise this issue in the Parliament, Paswan ji died of Heart attack; and subsequently there is no news of Constitution Amendment as agreed by Mr J P Nadda !

    Subsequently, on behalf of Dalit Medical Association Tamil Nadu, representations were sent to both the Parliamentary Committee for BC Welfare and SC/ST Welfare, requesting for Constitution Amendment in the Parliament. 

   The Parliamentary Committee for SC/ST Welfare took up the issue with the Government of India and till date there is no proper reply.

  Subsequently we submitted the same demand to the Hon'ble Prime Minister by name and Her Excellency the President of India by name, and from both the offices our letter was forwarded to the Ministry of Social Justice and Empowerment, Govt of India, with an advice to me to represent hereafter, anything on the above matter , to the Ministry of Social Justice and Empowerment, Govt of India.

Therefore we have represented to Hon'ble Virendra Kumar, Minister of Social Justice and Empowerment, Govt. of India and awaiting reply!

  As Parliamentary election is fast approaching, any political party interested in SC/ST/ OBC Welfare ,can promise to the electorate, if voted for power, would amend the constitution 

 in the Parliament to include Reservation Policy in the IX SCHEDULE of the Indian Constitution , to rectify the above Judgment of Hon'ble Supreme court of India.
